Ohio Medical Marijuana FAQs

To qualify for the Ohio medical marijuana card program (OMMCP) you must be diagnosed with one of the qualifying conditions on the Qualifying Conditions page.

The State Board of Ohio will set timelines for petitions to be filed electronically through the State's website. New qualifying condition petitions need to include:

•   The name and contact information
•   Specific disease or condition requested to be added
•   Information from experts who specialize in the study of the disease or condition
•   Relevant medical or scientific evidence
•   Consideration of whether conventional medical therapies are insufficient to treat or alleviate the disease or condition
•   Evidence supporting the use of medical marijuana to treat or alleviate the disease or condition and other types of medical or scientific documentation
•   Letters of support provided by physicians

A caregiver is a person who assist registered medical marijuana patient by representing them on their behalf at the dispensary. They are able to buy, transport, possess and administor medical marijuana to patients.

Registration Process: Caregivers go through the same registration process as patients, see the three step registration process.

  Must pay a $25 annual registration fee
  Once caregiver is registered with the OMMCP, the patient will need to designate the person as their caregiver.

Eligibility
Age: Must be at least 21 years of age.
Exception: Parents of a minor patient, who is 18 years of age or older may serve as the minor patient's caregiver.
Residency: Must be a resident of the state of Ohio to qualify for the Ohio medical marijuana program.

Rules
Caregiver Max: Patients may not designate more than 3 caregivers.
Patient Max: Caregivers may serve no more than 2 patients.
Exception: The state board of pharmacy may permit a caregiver to serve more than 2 patients under certain conditions, see here.

Exclusions
The state board of pharmacy shall deny a submission for a caregiver registration if the individual is identified on any of the following databases:

• System for Award Management (SAM)
• Excluded individuals and entities by the office of inspector general in the U.S. Dept. of HHS
• Dept. of Rehabilitation and Corrections
• Ohio DODD Online Abuser Registry
• Sex Offender and Child-Victim Offender
• The National Sex Offender Public Website
• Dept. of Rehabilitation and Correction
• The State Nurse Aide Registry

Patients who qualify for Veteran status may be able to have their registration fee reduced by 50%.

To register for one of these statuses make sure to inform your CTR that you qualify to register with a special status.

The state board of pharmacy may reduce registration fees to fifty per cent of the full registration price for a prospective patient who qualifies for indigent status, and any prospective caregiver for such a patient.
